ATCO Class Action Lawsuit
This class action was certified on May 23, 2019.
A class action lawsuit has been filed against ATCO LTD. in relation to the explosion of a private residence in the community of Dickinsfield, Fort McMurray, Alberta.
This class action stems from an explosion on May 16, 2016 shortly after ATCO Gas and Pipelines Ltd. reinstated the gas supply to the Dickinsfield community after the wildfires but before the evacuation order was lifted. The explosion destroyed several homes and significantly damaged several more within a one-half kilometre radius of the explosion.
This class action lawsuit was filed in the Court of Queen’s Bench of Alberta in Edmonton, Alberta on February 6th, 2017. It seeks, among other things, damages in the amount of $20 million for:
- Persons who suffered loss or damage to their property;
- The cost of repairs or replacement of the lost or damaged property;
- Additional living expenses incurred in the process of procuring alternate housing;
- Damages for mental and emotional stress related to the loss or damage of the property;
- Out-of-pocket expenses associated with the loss or damage of the property.
These allegations have not yet been proven in a court of law.

We hope to continue with Questioning (examination) of the parties in April and May. During this period, we will also continue to gather information to quantify the loss from the class member residents and insurance companies affected. These steps may move the class action closer to resolution, and in any event otherwise progress the action towards a common issues trial if required.
